HSE STARTS CONSULTATION PROCESS OF CDM

The HSE has just released the widely anticipated consultation document on the replacement of the CDM Regulations 2007.

The HSE states a key consideration is to tailor the Regulations towards smaller sites where it reports two thirds of construction fatalities now occur.

The Consultation is due to close in June 2014 with the new regulations coming into force in April 2015.

The headline changes are:

  • Simplified structure – 38 Regulations and 3 Schedules (around 25% smaller)
  • Removal of domestic client exemption
  • Removal of CDM Co-Ordinator role in favour of a Principal Designer (PD) role
  • Removal of explicit competence requirements
  • Withdrawal of the Approved Code of Practice in favour of practical guidance on compliance.

The proposal for domestic client exemption has been a major concern although it is now presumed that the principal contractor or contractor will carry out the requirements of the Regulations.

The introduction of the Principal Designer role in place of the CDM Co-Ordinator role further highlights the health & safety importance at the pre-construction stage.

The majority of the construction industry will be pleased to read that one of the key aims of the revised regulations is to remove the bureaucracy associated with demonstrating competence.  The new regulation includes a general requirement to ensure appropriate information, instruction, training and supervision to allow work to be carried out safely.
